New Balance Wins Trademark Claims Against Shoemaker (Corrected)

A Chinese shoe company’s use of the letter “N” on its shoes infringed New Balance’s trademark in the letter, the U.S. District Court for the District of Delaware ruled Dec. 4.

USA New Bunren Int’l Co.'s marketing on its website was sufficient to establish the “use in commerce” necessary for federal trademark infringement even if it didn’t actually sell the shoes in the U.S., the court said, in an issue of first impression in the Third Circuit.
