NetScout Freed From $3.3M Payout Over Nixed Patents by Fed. Cir.

The Federal Circuit issued opinions invalidating patents owned by Packet Intelligence LLC and wiping out a related $3.35 million infringement award against network security firm NetScout Systems Inc.

The decisions handed a win to NetScout, which since 2016 had been fighting Packet’s suit in the US District Court for the Eastern District of Texas and through two appeals. One affirmed an administrative tribunal’s invalidation of the patents at issue—related to the transmission of information over a computer network—in a separate case; the other vacated the decision against NetScout and remanded the case for dismissal.
