Netflix Wants Court to Kick Out ‘Bandersnatch’ Trademark Dispute

Netlfix says one snippet of dialogue in “Black Mirror: Bandersnatch” that references a “Choose Your Own Adventure” book isn’t enough to uphold the book publisher’s trademark infringement suit.

“A trademark owner cannot prevent others from using its mark in a purely descriptive sense,” Netflix said in a March 21 motion to dismiss. That’s what happens in the disputed scene in Bandersnatch, Netflix said. The protagonist uses the “Choose Your Own Adventure” book to describe his video game idea to another character.
