Netflix Can’t Escape ‘Choose Your Own Adventure’ Trademark Suit

Netflix Inc. failed to beat claims brought by the publisher of the “Choose Your Own Adventure” book series alleging that the “Black Mirror” film “Bandersnatch” misused its trademarks.

Chooseco LLC presented enough factual issues about Netflix’s alleged trademark infringement and dilution to allow its claims to continue, a Vermont federal court said Tuesday.

Chooseco publishes the “Choose Your Own Adventure” series made famous in the 1980s and ‘90s. It sued Netflix based on its “Black Mirror: Bandersnatch” interactive film, which uses a similar structure to the books.
