E.A. Sween Co. claimed Nestlé’s bakery products, including cookie dough and chocolate baking morsels, infringe on its longstanding trademark “SIMPLY DELICIOUS.”
E.A. Sween said it registered this mark in 2015, but has used it extensively since at least 1994 on packaging and advertising material for its own bakery products, including pastries, strudels, and muffins.
