The sale of “Nespresso Compatible” coffee capsules infringes Nespresso USA Inc.'s trademarks, an April 18 complaint in the Southern District of New York alleges.
Jones Brothers Coffee Co. misleads consumers into believing its coffee capsules are endorsed or sponsored by Nespresso by advertising them as Nespresso compatible on its website and packaging, the complaint says.
Jonas Brothers also allegedly infringes Nespresso’s trade dress by selling “nearly identical coffee capsules” with the same size, colors, appearance, and “dimpled” cone shape.
