The Federal Circuit erased a $13.2 million verdict and said the Texas jurors that awarded it relied on a faulty theory that point-of-sale manufacturer NCR Corp. was vicariously liable for infringement of two patents belonging to CloudofChange LLC.
The appeals court reversed a subsequent order denying a motion for judgment as a matter of law and vacated the jury’s verdict, according to a precedential opinion issued Wednesday by the US Court of Appeals for the Federal Circuit.
