Apparel and shoe company WaveyBaby Holdings LLC is suing MSCHF Product Studio Inc. for trademark infringement over the art collective’s “Wavy Baby” shoes.
WaveyBaby sent a cease and desist letter in April 2022, before MSCHF released the similarly named shoes with “the high potential for confusion,” according to a complaint filed Friday in the Eastern District of New York.
MSCHF acknowledged the letter, but “defiantly pressed forward,” according to the complaint.
“The Wavy Baby shoe blatantly and unmistakably incorporates a confusingly similar and almost identical variation” of WaveyBaby’s trademark, said the complaint, alleging that MSCHF’s infringement has caused “irreparable harm.” ...
