Motorola $544 Million IP Theft Award Gets Haircut on Appeal

Motorola Solutions Inc. retained most of a $544 million intellectual property theft award, though a $137 million copyright infringement portion needs to be reworked, the Seventh Circuit said Tuesday.

China-based Hytera Communications Corp Ltd failed to undermine a $407 million award for “large and blatant” theft of digital mobile radio trade secrets, the US Court of Appeals for the Seventh Circuit said. But the lower court erred by not letting Hytera argue that portions of the profits used to calculate copyright damages weren’t directly caused by the infringement, the three judge panel said.
