Monster Nets Millions, Share of Rival’s Sales in ‘Bang’ IP Fight

Monster Energy Co. and Orange Bang convinced a California federal court to confirm an arbitrator’s ruling that Bang Energy owed them $175 million and 5% of all future sales of Bang-branded products.

Vital Pharmaceuticals Inc., which goes by Bang Energy, failed to meet the high standard to convince a court to vacate an arbitration award, the US District Court for the Central District of California ruled Thursday. The arbitrator “appears to have taken great care” and provided a reasoned basis in his 177-page final opinion, the court said.
