My Energy Monster Inc. provides services to improve home and property energy efficiency, and operates in Massachusetts, Rhode Island, and Florida. According to the complaint, Energy Monster’s use of green and black in advertising is confusingly similar to Monster Energy’s color scheme.
The complaint also says Energy Monster’s ads at Worcester Railers games in the National Hockey League’s minor league are likely to confuse because Monster Energy advertises at nearby Boston Bruins and other NHL games.
