Monster Energy Rival Can’t Force It to Change Can Design

A rival of Monster Energy Co. failed in its bid to get a federal court in Florida to force Monster to change the can design for its sugar-free, no-calorie energy drinks.

VPX Sports “failed to meet any of the elements of a preliminary injunction” against Monster, the U.S. District Court for the Southern District of Florida said Oct. 16.

VPX said the design of Monster’s Reign sugar-free energy drink cans infringes the trade dress for its Bang sugar-free energy drinks. Monster’s cans closely resemble Bang’s color schemes, logo, and display of the drink’s ingredients, VPX said. VPX requested a preliminary ...
