Alnylam Pharmaceuticals, Inc. urged a federal judge on Friday to reject an argument from Moderna, Inc. that their patent infringement suit should be junked because Moderna was selling the allegedly infringing vaccine-related products to the US government.
Alnylam renewed its arguments to US District Judge Colm F. Connolly of Delaware, after the US government weighed in to bolster Moderna’s immunity defense in a separate infringement suit against the Covid vaccine maker.
Specifically, Alnylam said the government’s arguments, which could potentially shield Moderna from a patent infringement suit filed by Arbutus Biopharma Corp., don’t have the same force in its case ...
