Moderna Must Face Northwestern Patent Suit Over Covid Vaccine

A federal judge rejected Moderna Inc.'s request to dismiss the majority of Northwestern University’s lawsuit accusing the biotechnology company of infringing three patents covering vaccine-delivery technology to develop its Covid-19 shot.

Judge Richard G. Andrews nixed some of Northwestern’s allegations regarding one patent, but rejected the rest of Moderna’s motion to dismiss, according to an order issued Nov. 25 in the US District Court for the District of Delaware. Northwestern sufficiently demonstrated Moderna was aware of the patents and the accused vaccines practice the protected technology, he said.
