Micron Fails to Ax Patent Source Code Discovery Order on Appeal

Micron Technology Inc. failed to convince a Federal Circuit panel to wipe out a discovery order requiring the chipmaker to turn over 73 pages of source code files to lawyers for a Chinese competitor.

The district court reasonably concluded Yangtze Memory Tech. Co.'s “discovery request was not excessive or unreasonable” and that the protective order issued in the case was “sufficient to prevent against duplication or unauthorized access,” according to an order issued Wednesday by the US Court of Appeals for the Federal Circuit.
