Messi Sports Drink Doesn’t Rip Off Prime Trade Dress, Suit Says

The hydration drink “Mas+ by Messi” made in collaboration with soccer superstar Lionel Messi doesn’t infringe the look of influencer Logan Paul’s company’s “Prime” energy and hydration drinks, according to a federal lawsuit.

Prime Hydration LLC, partly owned by Paul, has repeatedly threatened to sue over commonplace trade dress elements, Mark Anthony International SRL said in a Tuesday complaint in the US District Court for the Southern District of New York.

The beverage maker—which owns White Claw, Mike’s Hard Lemonade and other alcoholic drinks—seeks declaratory judgment that Mas+ doesn’t infringe. It claims commonalities in functional bottle design elements and large ...
