Soccer superstar Lionel Messi and the maker of the sports drink Más+ by Messi told a federal judge that trade dress claims brought by influencer Logan Paul’s Prime Hydration LLC are an attempt to “suppress fair competition and “monopolize common design features in the hydration beverage industry.”
Prime Hydration’s alleged trade dress isn’t protectable because its seven features have been used by competing hydration beverages for years, and the company failed to plausibly allege consumers will confuse Más+ for Prime, according to an answer filed Dec. 20 in the US District Court for the Southern District of New York.
