The labor union representing performers at the dinner theater chain Medieval Times USA Inc. escaped a lawsuit in New Jersey federal court alleging the union was using the company’s trademark without permission.
The logo used by Medieval Times Performers United “is not confusingly similar” to the restaurant’s logo, and consumers are not likely to be confused given the union context, Judge William Martini said.
“Where, as here, a labor union uses an employer’s trademark as part of communications about the employer’s labor practices, courts have often held that that is unlikely to cause confusion,” Martini wrote in his decision Thursday ...
