Medical Device Trade Group Wants Federal Repair Rule Blocked

The Medical Imaging & Technology Alliance asked a federal judge to nullify a rule set by the Library of Congress that protects users who bypass passwords and encryption systems to access copyrighted software for the purpose of repairing medical devices.

The industry group argued the rule allows unregulated, third-party servicers of medical devices to exploit copyrighted software for commercial purposes.

Using the infringing software doesn’t fall under fair use because it isn’t transformative and will harm the medical devices market, MITA argued.
