McAfee Can’t Enjoin Former Employees on Trade Secrets Claims

Security software maker McAfee LLC failed to win a preliminary injunction to prevent three employees who left for a competitor from stealing trade secrets or breaching contracts, after a ruling from the Eastern District of Texas.

McAfee didn’t prove it was likely to succeed on the merits of its trade secret, tort, or contract claims, the court said Aug. 29.

Jennifer E. Kinney, Alan P. Coe, and Percy O. Tejeda all left McAfee to work at competitor Tanium Inc. McAfee sued, and requested a preliminary injunction against the defendants, which the court denied.
