Max Rack’s $1 Million Exercise Machine Trademark Award Nixed

A million-dollar compensatory damages award in a dispute between the owner of the “Max Rack” trademark and the manufacturers of a free-weight machine who allegedly used the mark without permission was vacated by an Ohio federal court.

The award wasn’t justified because there was no evidence of actual consumer confusion, the Southern District of Ohio said Tuesday. But Max Rack Inc. recovered some of the amount by getting its profits award doubled. It also won attorneys’ fees based on the infringement.
