Man Loses Appeal Over Convictions for Defrauding Tribal Entity

A man convicted of defrauding a Native American tribal entity out of the proceeds of a series of bond offerings worth about $60 million lost his Second Circuit appeal on Wednesday.

Devon Archer argued, among other things, that United States v. Landesman, decided by the US Court of Appeals for the Second Circuit in 2021, expanded the circumstances under which a district court may disregard a jury’s resolution of conflicting evidence, thereby silently overruling a 2020 decision in his case.
