Mallinckrodt Sues Air Liquide to Block Units’ INOmax Copy (1)

Mallinckrodt Plc alleges that a generic version of INOmax proposed by Air Liquide SA and its Airgas units infringes 11 patents for the nitric oxide gas therapy, according to a federal lawsuit.

Seven of the patents were part of Mallinckrodt’s 2015 infringement dispute with Linde Plc’s Praxair subsidiary, according to a complaint filed Dec. 30 and docketed Tuesday in the US District Court for the District of Delaware.

In August 2019, the Federal Circuit affirmed a Delaware judge’s ruling that Praxair’s copy wouldn’t infringe some Mallinckrodt patent claims, while claims of other patents were canceled.
