MAD Magazine successfully dropped a district court bid to cancel longtime cartoonist Don Martin’s widow’s trademark Monday—days after the pending claim derailed her appeal of its escape from infringement claims.
E.C. Publications, which publishes MAD, and parent DC Comics won summary judgment over Norma Martin’s infringement claims last year. But that wasn’t a final order, and a counterclaim to cancel her Doc Martin trademark registration—which MAD has since moved to drop—was pending when she appealed, the US Court of Appeals for the Eleventh Circuit said.
