Macy’s Inc. is facing a preemptive lawsuit seeking a declaration that the retailer can’t sue a maker of perfumes, candles, and other aroma products for trademark infringement because Macy’s ‘Hotel Collection’ mark isn’t distinctive.
Aroma360 LLC purchased the www.hotelcollection.com domain name in April 2020 after selling electronic diffusers under the H Hotel Collection name for several years, according to the complaint filed Thursday in the US District Court for the Southern District of Florida. While the US Patent and Trademark Office didn’t see any conflicts, Macy’s did, according to the complaint.
