Lululemon Targets Costco’s Kirkland Apparel in Trade Dress Suit

Apparel company Lululemon Athletica Inc. accused Costco Wholesale Corp. of infringing its trade dress and word trademarks by selling several Kirkland-branded items in a federal lawsuit Friday.

Costco sells clothing that infringes a variety of Lululemon designs and also uses terms Lululemon uses as trademarks, according to the complaint filed by Canadian and US Lululemon subsidiaries in the US District Court for the Central District of California.

Costco sells products that mimic the design of Lululemon’s “Scuba” hoodies, “Define” jackets, and “ABC” pants, while also using “Scuba” and “Tidewater Teal” trademarks that are infringing, the complaint said.
