L’Oreal Virtual Makeup Try-on Suit Paused for Patent Challenge

L’Oreal USA Inc. convinced a federal judge to pause a patent owner’s infringement suit against the cosmetics giant so its administrative challenge to the asserted patent can proceed.

Judge Joseph C. Spero ruled for L’Oreal, as the lawsuit’s still at an early stage, the administrative proceeding could narrow potential issues, and the pause won’t create an advantage for either side. The stay will last at least until the Patent Trial and Appeal Board decides whether to take up L’Oreal’s November petition to review the validity of a Brightex Bio-Photonics LLC patent, and will continue until a final decision if the ...
