‘Life Is Beautiful’ Festival’s Trademark, Copyright Wins Upheld

A music festival’s win in a copyright and trademark case over the phrase “Life is Beautiful” was upheld by the Ninth Circuit April 23.

The artist obtained trademark registrations in the phrase by fraud, the court said, and didn’t otherwise use it as a source identifier.

Thierry Guetta, an artist also known as Mr. Brainwash, incorporates the phrase “life is beautiful” into his artwork. Guetta’s art also features a splashed-paint heart. Guetta registered trademarks for the phrase and the heart, and registered a copyright on the heart.
