Liberty Bankers’ Marks Differ From ‘Bankers Life,’ Fed. Cir. Says

Consumers likely won’t mix up “Liberty Bankers Life Insurance Company” with “Bankers Life,” the Federal Circuit affirmed in a dispute between insurance competitors.

CDOC Inc.'s 1970 “Banker’s Life” trademark was deemed strong by the U.S. Court of Appeals for the Federal Circuit as it reviewed Liberty Bankers Life Insurance Co.'s victory regarding multiple proposed trademarks. But the marks’ shared elements were outweighed by dissimilarities, the prevalence of “Bankers” and “Life” in other insurance marks, and the care consumers take to buy insurance, the court said.
