Law firm Lewis Brisbois Bisgaard & Smith LLP failed to convince the Fifth Circuit to affirm its $1.5 million trademark infringement award against three defendants who registered the firm’s name as a new business in Texas.
A district court rightly found liability but wrongly awarded statutory damages under the Lanham Act after finding Michael Joseph Bitgood, Susan C. Norman, and Bradley B. Beers willfully infringed the firm’s trademark, according to the opinion released Thursday by the US Court of Appeals for the Fifth Circuit.
