Lego Must Face ‘Queer Eye’ Jacket Art Copyright, Trademark Suit

Lego Systems Inc. can’t escape an artist’s copyright and trade dress claims over a jacket in its “Queer Eye - the Fab 5 Loft” lego set, a Connecticut federal judge ruled.

A complaint by James Concannon sufficiently alleged that Lego copied enough of his jacket that a jury could find it infringed, the US District Court for the District of Connecticut said Wednesday. He also adequately pled a combination of stylistic elements that could constitute trade dress, while Lego failed to prove consumers wouldn’t think he endorsed its “Queer Eye” set, the court said.
