A complaint by James Concannon sufficiently alleged that Lego copied enough of his jacket that a jury could find it infringed, the US District Court for the District of Connecticut said Wednesday. He also adequately pled a combination of stylistic elements that could constitute trade dress, while Lego failed to prove consumers wouldn’t think he endorsed its “Queer Eye” set, the court said.
