A tattoo artist failed to overturn an Ohio federal jury’s verdict finding Take-Two Interactive Software Inc. didn’t infringe his copyrights by depicting his work on LeBron James in its NBA 2K video game series.
A reasonable juror could have concluded Jimmy Hayden granted LeBron James an implicit license to authorize use of his work as part of his own image rights—rights Take-Two validly acquired, the US District Court for the Northern District of Ohio said in an opinion Thursday. The court also rejected his argument that evidence allegedly undermining the existence of such a license was wrongly excluded.
