Lamborghini Thwarts Bid to Undo Lambo.com Cybersquatting Ruling

Automobili Lamborghini SpA convinced the Ninth Circuit to affirm its rights to claim “Lambo.com” over an individual whose acquisition of the domain indicated bad faith cybersquatting.

Richard Blair’s efforts to sell a domain invoking a famous trademark—while having not previously used “Lambo"—for as much as $75 million points to bad faith, the US Court of Appeal for the Ninth Circuit said in an opinion filed Thursday. The fact that Blair didn’t use the domain or deceptively acquire the mark didn’t outweigh several other factors favoring the Italian sports car maker, the panel said.
