La Quinta Worldwide LLC asked a Manhattan federal court Thursday to declare it has the right to use the trademark “Tomorrow You Triumph” over Triumph Hospitality LLC’s objections.
Triumph operates six hotels in New York City, including Hotel Edison, Hotel Belleclaire, and the Iroquois Hotel. La Quinta said it has used the slogans “Tonight La Quinta. Tomorrow You Triumph” and “Tomorrow You Triumph” in advertising since 2019.
The New York group filed with the USPTO to oppose La Quinta’s application to register the first mark and urge it to cancel its registration for the second based on likely consumer confusion. ...
