Medical device company Kurin Inc. told a California federal judge its competitor Magnolia Medical Technologies Inc. is “forum shopping” its patent infringement allegations over the creation of blood culture collection kits.
Magnolia’s allegations are related to a prior case between the two companies in Delaware federal court, according to a motion to transfer venue filed Monday in the US District Court for the Southern District of California. Chief Judge Colm Connolly of the US District Court for the District of Delaware has more than five years of experience overseeing the related allegations, Kurin said in its filing.
