Kurin Inc. convinced a California federal judge to move Magnolia Medical Technologies Inc.’s patent infringement lawsuit to Delaware by raising forum-shopping concerns over the allegations centering on blood culture collection kits.
Seattle-based Magnolia ignored the fact the company sued California-based Kurin in Delaware in prior litigation, Chief Judge Dana M. Sabraw said in an order filed Wednesday in the US District Court for the Southern District of California. Magnolia’s choice of forum has “little weight” when many of the factors deciding whether the court should grant Kurin’s transfer bid are neutral, he wrote.
