Kay, Jared Jewelers Win Dispute Over ‘Artistry’ Trademark

Sterling Jewelers Inc., with more than 3,600 retail stores under various names, including Kay, Zales, and Jared, won a federal court ruling yesterday that its Artistry Diamond Collection line doesn’t infringe trademarks held by wholesaler Artistry Ltd.

The U.S. District Court for the Northern District of Ohio granted summary judgment in favor of Sterling after concluding that Sterling’s use of the “Artistry” was not likely to create confusion among Artistry Ltd.’s clientele in the jewelry trade, who are likely to exercise significant care when acquiring goods from wholesalers (Sterling Jewelers, Inc. v.
