A federal appeals court again reversed a verdict against the charity Kars 4 Kids Inc., finding another non-profit waited too long to sue it for trademark infringement.
The Texas charity, America Can Cars for Kids, shouldn’t have been granted a $10.6 million award because it failed to justify its 12-year-delay in filing its 2015 claim to protect its “Cars for Kids” trademark, the US Court of Appeals for the Third Circuit said.
