Kangol LLC’s trademark win against an alleged infringer was vacated and remanded by the Seventh Circuit to an Illinois district court to determine whether its was permitted to serve the Chinese company legal documents by email.
The Hague Service Convention prohibits email service in China, but the lower court must determine whether the treaty applies since Kangol can bypass the rule if the company’s address was unknown, the US Court of Appeals for the Seventh Circuit ruled in a Friday opinion.
