Justices Reject TCL Challenge to Technology Patent Trial Loss

The Supreme Court won’t review TCL Communication Technology Holdings Ltd.’s loss in a patent infringement trial, a case TCL argued set a concerning rule for suits over standard essential patents.

TCL asked the justices to review a U.S. Court of Appeals for the Federal Circuit ruling that the question of whether a patent is essential to a technological standard can be decided by a jury. The ruling upheld a jury verdict that TCL owed nearly $1 million for infringing Godo Kaisha patents on LTE technology.

The full Federal Circuit refused to rehear the case in December.
