The creator of an athletic jump rope failed to convince the US Supreme Court to weigh whether an administrative tribunal’s invalidation of a patent should block an inventor from asserting the patent against alleged infringers in federal district court.
The justices on Monday rejected a petition from Jump Rope Systems LLC and inventor Molly Metz, which asked them to overturn precedent from the US Federal Circuit Court of Appeals that prevents plaintiffs from asserting patents in district court after the Patent Trial and Appeal Board has found them invalid.
