Judge Urges Fees for Dish, Sirius in ‘Exceptional’ Patent Suit

Dish Network LLC and Sirius XM Radio Inc. should be reimbursed for attorney’s fees spent beating patent suits from Dragon Intellectual Property LLC, but fees incurred at a patent office tribunal shouldn’t be included, a judge recommended.

Magistrate Judge Jennifer Hall in the U.S. District Court for the District of Delaware said in a Monday report Dragon’s suits were “exceptional” and “stand out from others” because Dragon continued to press the cases even though Dish and Sirius couldn’t infringe its audiovisual recording device patent.
