Breitling Wins Redo of Ruling in ‘Red Gold’ Trademark Dispute

A Connecticut federal judge said he erred in finding that watchmaker Breitling USA Inc.’s use of the “red gold” trademark wasn’t descriptive.

Breitling met the strict standard for reconsideration in asking the court to revisit its rulings, U.S. District Judge Michael P. Shea of the U.S. District Court of the District of Connecticut said. The California jeweler Solid 21 Inc. accused Breitling of infringing its “red gold” mark, which Breitling has said is too generic to be a valid trademark.
