The Federal Circuit’s active judges urged the DC Circuit to leave in place a panel ruling denying Judge Pauline Newman’s challenge to a law under which she was suspended from hearing cases.
The specialized appeals court’s judges argued that Newman, its oldest and longest tenured member, already had the opportunity to challenge her suspension before the Judicial Conference, the administrative body tasked by law to consider court actions sidelining jurists over misconduct or disability allegations.
