Accused infringer Quince defeated Ugg brand owner Deckers Outdoor Corp.'s bid to bar references to “dupes” and “dupe culture” in an upcoming design patent trial over shearling-lined shoes.
Judge Araceli Martinez-Olguin, of the US District Court for the Northern District of California, denied Deckers’ request on Wednesday during a hearing in Oakland, California.
“I’m actually kind of surprised by this motion in limine given you put it in the jury questionnaire,” she said, including “Do you hold any opinions, beliefs, or feelings—favorable or unfavorable—about companies that design, market, or sell ‘dupe’ products?”
