Jockey Sues ‘Black Jockey’ for Trademark Revival, Infringement

Jockey International Inc. accused Black Jockey Co. in a federal lawsuit of infringing some of its trademarks and convincing a trademark tribunal to wrongfully cancel others.

The Trademark Trial and Appeal Board nixed two trademark registrations dating to the 1960s “contrary and in spite off the substantial evidence,” Jockey said in a complaint filed Monday in the US District Court for the Northern District of Georgia. Meanwhile, Black Jockey failed to convince the TTAB that the “Black Jockey” mark it sought to register wouldn’t cause consumer confusion, Jockey said, accusing the company of infringing.
