JLM Couture Inc. will retain control of a disputed Instagram account during its litigation against dress designer Hayley Paige Gutman, a New York federal judge ruled after the Second Circuit remanded part of her injunction.
Evidence and testimony indicated Gutman assisted JLM with marketing efforts on the “misshayleypaige” Instagram account as well as on Pinterest, U.S. District Court for the Southern District of New York said. But it failed to make such a showing with regard to a contested TikTok account, which reverts to Gutman in a modified injunction, District Judge Laura Taylor Swain ruled.
