Businesses run by Kylie and Kendall Jenner incorporated ripped-off lace designs into lingerie, a lace manufacturer alleged in a copyright infringement lawsuit filed in a California federal court.

The Kylie Shop Inc. and Kendall Jenner Inc. sell a thong and a slip that incorporate lace designs identical, or close to it, to designs that Klauber Brothers Inc. registered with the U.S. Copyright Office, the lace company said in its complaint.

The lawsuit, filed Wednesday in U.S. District Court for the Central District of California, also names Nordstrom Inc. and Jet.com for selling the products, and reserves the right to include other manufacturers and vendors discovered in litigation.

Klauber Brothers said it would decide later whether to pursue statutory damages of $150,000 per infringed work or actual damages, according to the complaint.

Cause of Action: Copyright infringement

Relief: Damages, injunctive relief, attorneys’ fee

Response: The Kylie Shop didn’t immediately respond to a request for comment

Attorneys: Doniger / Burroughs

The case is Klauber Brothers, Inc. v. The Kylie Shop, Inc. et al., C.D. Cal., No. 20-415, Complaint 1/15/20
