Jack Daniel’s Again Asks Supreme Court to Take Up Dog Toy Case

Jack Daniel’s Properties Inc. asked the US Supreme Court to review a ruling that a dog toy doesn’t infringe its trademarks—returning after the high court denied an earlier petition in January 2021.

The US Court of Appeals for the Ninth Circuit said VIP Products LLC’s “Bad Spaniels” pun-laden chew toy expressed a humorous message and invoked First Amendment concerns. The Arizona federal district court “begrudgingly” entered judgment, “lamented” the appeals court’s reasoning, and encouraged the whiskey company to appeal to the high court again, according to Jack Daniel’s’ new petition docketed Wednesday.
