The US Court of Appeals for the Ninth Circuit said VIP Products LLC’s “Bad Spaniels” pun-laden chew toy expressed a humorous message and invoked First Amendment concerns. The Arizona federal district court “begrudgingly” entered judgment, “lamented” the appeals court’s reasoning, and encouraged the whiskey company to appeal to the high court again, according to Jack Daniel’s’ new petition docketed Wednesday.
