J&J’s DePuy Gets Spinal-Fusion Patent Nixed Ahead of Trial (1)

Johnson & Johnson’s DePuy units convinced a federal judge on Tuesday to cancel an RSB Spine LLC patent for implant devices used in spinal fusion surgeries less than two weeks before a jury trial over alleged infringement of that and another patent is set to begin in Delaware.

In a separate order, Judge Richard G. Andrews denied DePuy’s bid for a non-infringement judgment as to the second patent. Both orders were issued Tuesday in the US District Court for the District of Delaware.

A jury trial is set to begin Dec. 5 in Wilmington, Del.
